Critical Analysis of the Amendments to Law No. 19.496 on Consumer Rights Protection Regarding Alternative Dispute Resolution for Individual Consumer Disputes. Where Are We Headed?
Since 2011, Law No. 19.496 on the Protection of Consumer Rights (Consumer Law) has been amended with the aim of introducing alternative dispute resolution mechanisms (ADR) and expanding their scope of application. However, as of the date of this work, the use of ADR in individual consumer disputes is not a prevailing trend in Chile. In this context, the purpose of this article is to analyze the amendments to the Consumer Law in relation to ADR, and specifically those concerning individual disputes.
