This work claims, based on a systematic interpretation of the rules of the Civil Code, its complementary laws and the principles related to family law, that there is no full equality in the legal treatment of heterosexual couples and same-sex couples, since, apparently, there is a dissimilar legal regulation between them regarding the application of assisted human reproduction techniques. This situation is contrary to the principle or constitutional guarantee of equality enshrined in the Political Constitution of the Republic of Chile and in various international treaties on the subject.
